Dog law, criminal law, or political office demands a sworn duty to protect the Constitution but this first-hand account proves we may be at risk before the bench..

 

A judge not bound by the Constitution is free to become a "social justice warrior" with the power to determine their own interpretation of law and justice. The judge I'm going to name never lawfully subscribed to the Oath of Office, therefore every decision he's rendered in any case is unlawful. How systemic and wide-spread is this? Is it just this one judge or could it be a widespread judiciary problem?

 

This judge's dad was a former Democrat Speaker so I'm about to expose a politically connected judge. Hopefully we do not have a two-tier justice system in Oklahoma the way we're all seeing in Washington DC today.  No citizen should be held liable for exposing the cold hard facts.

 

What happens when a judge violates his Oath of Office? Judge Bradford Benson was presiding over a case when I heard him nonchalantly disregard the arguments made under the protections, liberties and safeguards of the United States Constitution. (see below) I could not understand how a judge could so blatantly violate the Oath to the United States Constitution that our military members give their lives to support and defend. I am a licensed Private Investigator and retired military veteran, so I decided to investigate what kind of corruption and/or incompetence that it would take to so obviously trample the U.S. Constitution.

 

The following excerpt is part of the Oath of Office for all state officers according to Article XV of the Constitution of the State of Oklahoma. Your state will have something similar.

 

OKLAHOMA CONSTITUTION - SECTION XV-1

     Officers required to take oath or affirmation - Form.
All public officers, before entering upon the duties of their offices, shall take and subscribe to the following oath or affirmation:

     "I, _________, do solemnly swear (or affirm) that I will support, obey, and defend the Constitution of the United States, and the Constitution of the State of Oklahoma, and that I will not, knowingly, receive, directly or indirectly, any money or other valuable thing, for the performance or nonperformance of any act or duty pertaining to my office, other than the compensation allowed by law; I further swear (or affirm) that I will faithfully discharge my duties as _________ to the best of my ability."

     The Legislature may prescribe further oaths or affirmations.

     Amended by State Question No. 466, Legislative Referendum No. 178, adopted at election held on Sept. 9, 1969.

 

SECTION XV-2

     Administration and filing of oath - Refusal to take - False swearing.

     The foregoing oath shall be administered by some person authorized to administer oaths, and in the case of State officers and judges of the Supreme Court, shall be filed in the office of the Secretary of State, and in case of other judicial and county officers, in the office of the clerk of the county in which the same is taken; any person refusing to take said oath, or affirmation, shall forfeit his office, and any person who shall have been convicted of having sworn or affirmed falsely, or having violated said oath, or affirmation, shall be guilty of perjury, and shall be disqualified from holding any office of trust or profit within the State. The oath to members of the Senate and House of Representatives shall be administered in the hall of the house to which the members shall have been elected, by one of the judges of the Supreme Court, or in case no such judge is present, then by any person authorized to administer oaths.

 

Through a Freedom of Information Act request and a small copying fee I received a copy of Judge Bradford Lee Benson’s Oath of Office (click "Oath Of Office" at left to enlarge in a window) subscribed to on 14 Jan 2019 and filed on 8 Feb 2019 in Tillman County Clerk’s Office, certified and sent to me by District Court Clerk Kevin Stevens on 8 Aug 2019.

 

What I found may be the reason Judge Bradford Lee Benson refused to support, obey and defend the ii Constitution of the United States, because Judge Benson’s Oath of Office completely omits the acknowledgement of his duty to the U.S. Constitution.

 

Judge Bradford Benson’s Oath of Office reads: "I, Bradford Lee Benson, do solemnly swear (or affirm) that I will support, obey, and defend the Constitution of the State of Oklahoma, and that I will not, knowingly, receive, directly or indirectly, any money or other valuable thing, for the performance or nonperformance of any act or duty pertaining to my office, other than the compensation allowed by law; I further swear (or affirm) that I will faithfully discharge my duties as Associate District Judge of Tillman County Oklahoma to the best of my ability."

 

This is a clear violation of Article XV Section 1 of the Oklahoma Constitution. Is it willful dereliction of the primary duty of a judge or extreme lack of understanding of the duties of a judge or both? Oklahoma will soon see if our elected officials have created a two-tier justice system wherein a politically connected son of a former State Speaker of the House is given a pass where a less politically connected Oklahoman would at the very least be removed from office.

 

Judge Benson failed to lawfully assume the duties of judge as he did not properly subscribe to the Oath of Office. This should be considered willful neglect of duty. At the very least this failure indicates Judge Bradford Benson lacks experience or that he does not possess the knowledge necessary to perform the duties of a judge to adhere to, support, obey and defend the Constitution of the United States and the Constitution of the State of Oklahoma.

 

Every person in every court case Judge Bradford Lee Benson has presided over could be a victim of fraud. Every case he adjudicated must be thrown out and/or reheard under a judge that has lawfully and properly subscribed to the Oath of Office to “support, obey, and defend the Constitution of the United States, and the Constitution of the State of Oklahoma.

 

My soldiers did not give their lives upholding their oath “to support and defend the Constitution of the United States against all enemies both foreign and domestic” so that any sitting judge could spit on the ii Constitution of the United States.
